Testamentary trusts A testamentary trust can be useful, but it does not avoid probate, nor treat the other problems just mentioned. Again, a testamentary trust is one that is written in a will. After a decedent's death, the Probate Court orders the trust created at the end of the administration of the probate estate. 
Sometimes testamentary trusts are a good idea when the client wants the administration of the trust to continue to be supervised by the Probate Court. A testamentary trust, after its creation, continues under the jurisdiction of the court. Back
